                              Lease Agreement

Landlord and Tenant agree to lease the Premises at the rent and for the term and on conditions as follows:


1. Date of Lease.                          


1.1         Rental property will continue to be shown to prospective renters and advertised for rent
              until this signed Lease agreement is returned to Landlord with booking deposit.

2. Premises:                    168 Norfolk Drive East Hampton, NY 11937

3. Term of Lease:    This Lease shall begin at 3:00 PM Saturday
                                This Lease shall terminate at 10:00 AM Saturday

4. Payments:   Total rent for term

5. Security:

Security in the amount of  $.  Shall be paid on Signing, and shall be held by Landlord for any damage that may be caused in any part of the house, property or furnishings (ordinary wear and tear excluded) or, if required, for the cleaning of the premises or for the payment of outstanding bills, and or added expenses incurred during the term of this lease.  The parties agree that no part of the security shall be applied to the payment of rent.  Within 14 days following the termination of the Lease, Landlord agrees to return the security deposit to the Tenant (S), adjusted for any damages, and/or outstanding bills.

6. Uses:

The premises shall be used as a private dwelling only by the Tenant (S), the Tenants family, staff, and non-paying guests.  Tenant (S) shall comply with all laws and ordinances, cleanliness, and use of the premises.  Tenant (S) specifically represents that this house is not for the purpose of a “share house” as defined by local zoning code and that if fines are levied against the Tenant (S) or Landlord as a result of a breach of this representation, the Tenant (S) shall pay all such fines.  Landlord agrees that if Tenant (S) pays the rent and is not in default under the Lease, Tenant (S) may peaceably and quietly have, hold and enjoy the premises for the term of the Lease.

7. Liability:

Landlord shall not be liable for any injury, death, loss, expense, or damages to Tenant (S) or its property, or to any person who uses the premises, including the swimming pool, during the term of the Lease. 

8. Condition of Premises:

Landlord agrees to deliver the premises free of tenancies, furnished in a manner substantially the same as the Tenant (S) had first inspected. Tenant(S) acknowledges inspection of the property and accepts it in “as is” condition. If Tenant(S) has not inspected the premises, Tenant(S) waives the right to withhold claim that the property has been misrepresented. Tenant (S) agrees to notify Landlord, at the commencement of the term hereof, of any defects or damages. Reporting repairs does not give the Tenant the right to cancel this agreement or receive a refund of any payments made and Landlord shall not be liable for any such defects or damages.

9. Repairs:

Tenant (S) shall keep and return the premises and all appliances, equipment, furniture clean and in good repair. Landlord shall be responsible for repairs, except when a repair is required as a result of fault or abuse on the part of the Tenant (S); in which case the Tenant (S) shall pay for the repairs.  Tenant (S) shall immediately notify the Landlord of any condition requiring repair.

10. Alterations:

Tenant (S) must not, without prior written consent from the Landlord, make any alterations to the premises.

11. Utilities & Services:

Tenant (S) shall pay all applicable charges for utilities, including but not limited to gas, home heating oil, water, electric, interior cleaning, telephone, cable, internet, and trash removal during the term of the Lease.  In the event the Tenant (S) defaults in the payments of such charges and the Landlord must assume them in order to discharge these claims, then such charges shall be deducted from the security deposit.

12. Pool:

Landlord shall be responsible for opening and closing the pool in accordance with local standards.  

12.1:Tenant (S) agrees to pay for weekly cleaning service including the cost of chemicals during the
term of the Lease.

12.3 The use of oil for the pools’ heater is NOT included under section 11.1 of this Lease and is
considered an added expense, as described in section 5 of this Lease, and must be paid
separately.  Any oil used during the term of this Lease for the purposes of pool heating will be
billed at the current rate charged by our supplier at the time of  rental.  

12.4:Landlord is not responsible for any injury or death to Tenant (S), staff, and or family members,
and or their guests resulting from: swimming, running, falling, slipping, jumping, or diving into,
around, or in pool.

13. Care of Grounds:

Tenant (S) shall, at their own cost and expense, have regular lawn mowing and weeding as applicable.

14. Pets:

Tenant (S) will not keep or permit any pets on the premises unless described separately and agreed to by Landlord.

                       refundable security is required and is subject to the same terms as section 5 of this Lease.

15. Smoking:

Tenant (S) agrees not to smoke in the dwelling and to prohibit Tenants family members, staff, and guests from smoking in the dwelling.

16. Tenants Default:

Landlord may give written notice to correct a default or defaults under the terms of the Lease.  If Tenant (S) fails to correct default(s) described in said notice, Landlord may cancel the Lease by giving Tenant (S) a written  notice of cancellation of this Lease and this Lease and the term hereunder shall end and expire and the Tenant (S) shall then quit and surrender the premises but Tenant (S) shall remain liable for its obligations under this Lease, and for all costs pursuant to satisfying said obligations.  Upon signing and payment of this Lease by Tenant (S),  this Lease will remain in effect until the end of said term, and Tenant (S) shall remain liable for its obligations under this lease, and for all costs pursuant to satisfying said obligations. 

17. Access:

Landlord or its agents may at reasonable times and upon reasonably notice (which notice may be verbal) enter premises to examine, to make repairs and alterations, and to show it to possible Buyers, Lenders, or Tenant’s.

18. Cancellations: 

A thirty (30) day notice is required for cancellation. Cancellations that are made more than thirty (30) days prior to the arrival date forfeit the reservation (booking) deposit. Cancellations or changes that result in a shortened stay or that are made within 30 days of the arrival date, forfeit the full advance payment and reservation deposit. Cancellation or early departure does not warrant any refund of rent or deposit. 

 18.1:       No refunds will be given for storms.  

No refunds will be given for any adverse atmospheric or weather phenomenon. 

No refunds will be given for the adverse effects of a storm or other unforeseeable "act of God" 

No refunds will be given for the loss of electrical power, flooding, downed trees or limbs or
damage to property or self that may occur as a result of any or all of the aforementioned
occurrences or any occurrence that may be deemed an "act of God"    

19. Travel Insurance:

We highly recommend you purchase travel insurance.  Plans are available at VRBO.com , Homeaway.com, or other insurancce providers.


LANDLORD AND TENANT(S) AGREE TO ABIDE BY THE TERMS AND CONDITIONS 
AS SET FORTH IN SECTIONS ONE (1) THROUGH NINETEEN (19) OF THIS LEASE
